Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are an electronic record under the Information Technology Act, 2000 ("IT Act") and the rules made thereunder, and a legally binding agreement between you and BITBOUND PRIVATE LIMITED ("Company", "we", "us"), formed by electronic means under Section 10A of the IT Act. They govern your access to and use of AI Image Studio (the "Service"). By creating an account or using the Service, you accept these Terms. If you do not agree, do not use the Service.

2. Definitions

"Service" means the AI Image Studio website and the AI image generation features offered on it. "Credits" means prepaid units used to pay for generations. "Inputs" means prompts, settings, and other material you submit. "Outputs" means images generated by the Service from your Inputs. "You" means the individual accepting these Terms.

3. Eligibility and Accounts

You must be at least 18 years old and competent to contract under the Indian Contract Act, 1872. You agree to provide accurate registration information, keep your credentials confidential, and remain responsible for all activity under your account. Notify us promptly at [email protected] of any unauthorized use.

4. The Service

The Service generates images from text prompts using third-party AI models. Features, models, and pricing may change. We do not guarantee uninterrupted availability and may perform maintenance with or without notice.

5. Credits and Payments

The Service operates on prepaid Credits. Prices are shown at the point of purchase and are inclusive of applicable taxes, including GST, unless stated otherwise. Payments are processed by third-party payment processors; we do not store complete payment card details. Credits are not money or a deposit, carry no monetary value outside the Service, are non-transferable, and are redeemable only against generations, except as provided in our Refund Policy. If a generation fails for technical reasons, the Credits charged for it are automatically returned to your balance.

6. Acceptable Use

In line with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, you must not use the Service to create, host, display, upload, publish, transmit, or share any content that:

  • belongs to another person and to which you have no right;
  • is obscene, pornographic, paedophilic, invasive of another's privacy including bodily privacy, insulting or harassing on the basis of gender, or racially or ethnically objectionable;
  • is harmful to children;
  • infringes any patent, trademark, copyright, or other proprietary rights;
  • deceives or misleads about the origin of the message or knowingly communicates misinformation;
  • impersonates another person;
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or incites the commission of any cognizable offence;
  • contains malware or violates any law in force.

You must also not reverse engineer the Service, abuse or overload its infrastructure, scrape it by automated means, or circumvent the Credit system. We may suspend accounts that violate this Section.

7. Your Prompts and Inputs

You retain your rights in your Inputs. You grant us a limited, non-exclusive, worldwide licence to process your Inputs solely to operate the Service, including transmitting them to the model providers that perform generation. You represent that you have all rights necessary to submit your Inputs.

8. Generated Images and Intellectual Property

Subject to these Terms and to the licences of the underlying AI models, we assign to you the rights we hold, if any, in Outputs you generate. You are responsible for your use of Outputs, including compliance with applicable law and third-party rights. The Service, its software, and branding remain the property of the Company and its licensors.

9. AI Output Disclaimer

Outputs are generated by probabilistic models. They may be inaccurate, incomplete, or offensive, may resemble Outputs generated for other users, and may unintentionally resemble existing works. Outputs are not professional advice. You must review Outputs and are solely responsible for relying on or publishing them.

10. Third-Party Services

Generation is performed by third-party model providers, and payments by third-party processors. Their own terms may apply to you. We are not responsible for third-party services we do not control.

11. Suspension and Termination

We may suspend or terminate your access for breach of these Terms, including Section 6, or where required by law. You may stop using the Service and request deletion of your account at any time. Sections that by their nature survive termination (including Sections 8, 9, 12, 13, and 14) survive. Refunds of unused Credits on termination are handled under the Refund Policy.

12. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits rights available to you as a consumer under the Consumer Protection Act, 2019 that cannot be waived by agreement.

13. Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for indirect, incidental, special, or consequential damages, or loss of profits, data, or goodwill. Our aggregate liability for all claims arising out of the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. Nothing in this Section excludes liability that cannot be excluded under Indian law.

14. Indemnification

You agree to indemnify and hold harmless the Company from claims, damages, and expenses (including reasonable legal fees) arising out of your Inputs, your use of Outputs, or your breach of these Terms or applicable law.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Subject to Section 16, the courts at Faridabad have exclusive jurisdiction over disputes arising out of these Terms. Nothing here prevents you from seeking remedies available under the Consumer Protection Act, 2019 before the competent consumer commissions.

16. Grievance Redressal

In accordance with the IT Rules, 2021, our Grievance Officer is SUBHASH KUMAR THAKUR, reachable at [email protected]. Complaints are acknowledged within 24 hours and disposed of within 15 days of receipt.

17. Changes to These Terms

We may update these Terms. Material changes will be posted on this page with a new effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
